Why does the final sentence, "Plutôt fuir que d'être pris la main dans le sac," utilize être in "d'être pris" vs avoir like in "d'avoir pris." ???

Here it means 'to be caught red-handed' which as in English uses the verb to be (être).

It is a passive construction, which is always constructed with être.
